Could Trump Be The New Reagan?
Could Trump turn out to be another Reagan, a great GOP leader we look to for years a means of what our next leaders should follow, to look at his accomplishments as a test of against what theirs are?
I remember as a kid, I was 18 and ready to vote, who were the two people running for office? Reagan vs Carter. Reagan was a very eloquent speaker, knew how to draw his audience in, then would relax all of them with his self-depreciating humor, he was lax in his style of speaking, but you leaned forward to hear what he was saying. It was during one of these debates, a week before election that he turned to the camera’s, not Carter, and asked them all, “Are you better off then you were four years ago? Next Tuesday is Election Day; all of you will go to the polls, stand there in the polling place and make a decision. I think when you make that decision it might be well if you ask yourself, “Are you better off then you were four years ago? Is it easier to go and buy things in the store then it was four years ago? Is there more or less unemployment in the country then there was four years ago? Is America as respected throughout the world as it was?”
He went on with his speech, but I remember asking my father the same question, “Are you better off then you were 4 years ago?”, asked others as well, I was only 18, not sure if I knew of the difference of how things were between 14 and 18, the economy was not a thing you thought about. I think this simple set of questions aided him in his winning that election.
I also need to point out, while the press was not near the level of hostility towards Reagan and outright openly liberal as they were during Trump’s election, but they were no friend of Reagan’s, the problem was Carter was such a weak and terrible president, it was hard to stand up on his merits, but I promise, if you had the same press today back then, they would have tried to make this inept president look like Lincoln (just like they have done with Obama).
The changing of the High Court
But what did Reagan do that has him even now remembered as possibly one of the greatest Republican presidents since Lincoln? With that we need to look at what he did, and that list is rather large.
- Reagan made four successful appointments to the Supreme Court during his eight years in office.
- In 1981, he successfully nominated Sandra Day O’Connor to succeed Associate Justice Potter Stewart
- The first woman on the Supreme Court, O’Connor retired from the Court in 2006, and was generally considered to be a centrist conservative
- In 1986, Reagan elevated Associate Justice William Rehnquist to the position of Chief Justice of the United States after Warren Burger chose to retire.
- Reagan successfully nominated Antonin Scalia to fill Rehnquist’s position as an associate justice of the Court.
- Finally, Reagan nominated Anthony Kennedy, who won Senate confirmation in February 1988.
- Reagan also appointed 83 judges to the United States courts of appeals, and 290 judges to the United States district courts.
In the Kennedy nomination Reagan faced a battle, first he had Robert Bork nominated, the DNC in the Senate set about attacking the nomination, they then had Hollywood jump in on the act. The reason, Bork was a strict follower of interpretation the constitution by the intent of the writers, in other words dealing with the constitution as a living changing concept was not in his view correct, he thought we needed to view what was written in the eyes of who wrote it.
Naturally the DNC started with Women were going to have to return to back alley abortions, elderly would be pushed off of cliffs in their wheelchairs, and hiring quotas that were in place at the time would cease. Of course this was all drafted and aided in its presentation by a then Senator Joe Biden, who later in the George H. W. Bush put in place the Biden Rule that prevented Bush from appointing a supreme court justice.
This is something the left knew would tip the high court so far to the right, they would not have a prayer of seeing it change for at least 20 years, so they put in place a President in his last year of office should not be able to appoint a justice, he should let the voters decide and thus the next president. Seems like the nuclear option, the DNC were not happy when their own laws came back to bite them, they were not happy then when in the last year of Obama’s term they refused to take up a nomination by him to the supreme court, and who yelled the most about this? Well turns out it was Joe Biden.
Trump’s moves in the judicial realm:
The courts were poised to make changes more the left with the death of Antonin Scalia, who by the way was appointed by Reagan, this happened during the last year of Obama’s term, the Senate then put in place the Biden rule, which you just saw in the video he mysteriously forgot about when he was effected by his own rule, so Trump took over the nomination, he put in place Neil Gorsuch.
One would say that Gorsuch is a strict constitutionalist, he has said concerning justices and the law:
….to apply the law as it is, focusing backward, not forward, and looking to text, structure, and history to decide what a reasonable reader at the time of the events in question would have understood the law to be—not to decide cases based on their own moral convictions or the policy consequences they believe might serve society best.
One also has to remember, due to he is only 49 we could look to him sitting on the bench for at least another 20 years, even longer if he wishes to follow the path of other justices.
It is too early for one to say that Trump will have the same effect on the high courts that Reagan did, but there is a good chance we may see one more vacancy over the next two years, either due to health or end of life. You have Justice Ruth Bader Ginsburg who has said she will not retire while Trump is in office, she does not wish her seat replace by a conservative justice, but if Trump wins another term, she may have no choice in the matter, at 84 years old she is not expected to be able to carry on as she did 20 years ago, we also know as we did with Justice Antonin Scalia, what you want and what life wishes are two separate paths.
You also have Stephen Breyer who is 79, he is part of the left leaning court, and Anthony Kennedy, the final Reagan appointee on the court he is 81, I expect of the next 3 years to see one of these three replaced, if it is Kennedy, one will not see the court shift much with a Trump appointment, but if it is Breyer or Ginsburg, we could see a large shift of the courts in the same way we saw with Reagan, and like him Trump could set the path of the court for the next 20 to 30 years.
The Federal Courts and Appeal Courts
In this way Hillary Clinton was correct, the election was not only about policy, more importantly it was about the supreme court, nothing causes the left more concern then the court changing more the right, if Trump can replace these three, all you would have left on the court are the Obama appointees, Sonia Sotomayor, and Elena Kagan, both very liberal justices, the court then would go to a 6 to 2 split with the conservative justices in a majority. This would actually be a better shake up of the courts then Reagan had done.
While I think this was the most important act Reagan did to protect the direction this nation took, this was just a small portion of what he had done, the appointments of federal justices, appeal justices also aided in that change, for it had changed the way the law was interpreted in the federal courts. We saw this in effect until Clinton first started to change the demographics of the courts, then Obama finished by putting in many of the activist justices we see how.
Trump has the ability to change this, he already is, and at this point he has place on federal courts, appeals courts. At this time he has place 12 new justices on the appeal courts, he also has another 7 waiting for confirmation, with the majority in the senate.
This may not seem like much, but when you look at the appeals court, there are a total of 11 courts, on the benches sits 179 Judges, with 12 to date and another 7 waiting for conformation you are looking at 19 seats filled, or 10% of the court of appeals being filled in the first year by Trump. Obama in 8 years filled 55 seats, this is why the appeal courts are so far to the left, this means that Obama placed almost 1/3 of the justices sitting on the courts, Bush put 66 justices on the seats, today 44 still sit on the their seat, that means that he too changed the court as it sits today by 25%, remember, Trump’s own pick for Supreme Court justice came from this group.
We then look at Clinton, the courts today have of his 66 appointees, there still sits 34 of his appointees on the bench, that means between Clinton and Obama there sits today 89 Justices on the court of Appeals, this means 1/2 of the court is made up of liberal justices appointed by Clinton and Obama, and people wonder why they keep blocking Trump, this is very well the reason why.
With Trump in office we have already seen his move to stop this, between him and Bush they now have the other half of the justices appointed into office, Trump is appointing at a pace even greater then Clinton or Obama, he could very well end up with 75 justices, add to this the 46 that now sit on the bench from Bush, even we see 15 drop off, you would still have the court of appeals with 60% of conservative appointed justices, this would not only change the complexity of the courts, but of our whole legal system for years to come.
Due to time given to research this, I need to continue this tomorrow, I will then look into the freeing up of regulations, the move of the tax’s that Trump has put in place just last week, and what we can expect in the future as more of his policies take place and congress and the senate are forced to put more of his cabinet posts filled with deputy directors, yes they are still obstructing this, changes will increase in scope, snowballing into something much greater then what we have today.
Much of what he does depends on if we can get the GOP leaders in both the senate and house to take up the mantel, to hold the DNC responsible for their diversionary and obstructionism tactics, then expose them to the world. We know this will be hard, sadly the press has gone so far into the camp of the left that they are no longer willing to present any truth that is harmful to their ideology. So how do we do this then? We do this by how I am doing it, spread the news over the intent, on forums, share with your friends, soon the truth will be too overwhelming to deny.
