Left Has Meltdown When Judge Checks Biden On Mask Mandates

In a move that left half of America happy, the other running for their safe rooms, a federal judge struck down the Biden mask mandates on public transportation under federal control, such as aviation and transit on trains.

According to PJ Media:

A federal judge in Florida on Monday struck down the Center for Disease Control and Prevention’s (CDC) federal mask mandate for public transportation, granting summary judgment to the Health Freedom Defense Fund Inc., which had challenged the mandate.

U.S. District Judge Kathryn Kimball Mizelle, who was appointed to the bench by former President Donald Trump, ruled that the mandate “exceeded the CDC’s statutory authority, improperly invoked the good cause exception to notice and comment rulemaking, and failed to adequately explain its decisions.” Therefore, Mizelle wrote, “the Court declares unlawful and vacates the Mask Mandate.”

As a result, the judge remanded the mandate back to the CDC for “further proceedings consistent with this order.”

The White House said the federal court ruling Monday to void the Biden administration’s mask mandate for travelers using public transportation such as trains and airplanes was “obviously a disappointing decision” in light of the Centers for Disease Control and Prevention (CDC) recommending its order for passengers to wear face coverings be extended.

The ruling from U.S. District Court Judge Kathryn Kimball Mizelle came in a case brought in Florida federal court by Health Freedom Defense Fund, Inc. and frequent air travelers Ana Daza and Sarah Pope against the administration.

Judge Mizelle determined that the mandate violated the Administrative Procedure Act by being outside the scope of the CDC’s authority, was “arbitrary” and “capricious,” and did not go through the required notice and comment period for federal rulemaking.

It is unclear if the Biden Administration will appeal this ruling.
